SKALE PRIVATE LIMITED (“SKALE“, “we”, “us”, or “our”) provides cloud based ecommerce solution (the “Software“) and services (the “Services“) accessible through the builtbyskale.com website. The Software is licensed under the GNU General Public License (GPL). When using the Software, you receive all rights granted under the GPL. These Terms of Service govern your access to and use of our website and its Services. By using the Services in any way, you are agreeing to comply with these Terms of Service and our Privacy Policy.


When you sign up for SKALE's Services, you agree to give us accurate info and keep it up-to-date so we can reach you about your account. We might send important emails, like updates to our Terms or Privacy Policy, or legal notices about how you use the Services, so you can stay informed.

You're responsible for everything that happens on your account. Keep your account secure by protecting your password, username, and email address. Tell us right away if you suspect unauthorized use. If we think your account's been compromised, we might suspend or disable it.

The account owner is the person with access to the email address used to create the account, not necessarily the one who paid for it. Owners can't share account access. If it's a company account, one authorized employee can access it.


Our services are not intended for use by children. You are not permitted to access or use our services if you are under the age of 13 (or 16 in Europe). If you are older but under the age of 18, you may only use our services under the supervision of a parent or legal guardian who agrees to these Terms of Service.

Fees, Payment, and Renewal

When you use our services, you agree to pay the specified fees charged to your credit card or through our payment provider. The fees might vary depending on taxes in your location, which will be added during checkout. It's your responsibility to report and pay all applicable taxes in your country.

You'll be billed upfront for a one-year subscription when you purchase. The subscription starts on your purchase date. We'll automatically charge the fees and taxes annually until you cancel your subscription, which you can do anytime by logging into your SKALE account and going to Subscriptions. If you used a discount or coupon code, your subscription will renew at the full price when the discount period ends. If you have multiple subscriptions, they might renew on different dates. We don't offer refunds or credits for partial use, downgrades, or unused time.

We may change our fees with notice, either by email or on our website. If you don't agree with the changes, you can cancel your subscription.

Updates and Support

When you buy a subscription, you'll get access to downloads, updates, and support as long as your subscription is active. If you cancel your subscription, you'll need to renew it to keep getting updates, support, or to download files again.

Updates are only available for the websites you bought the subscription for. Support is provided through the SKALE support system and only for the software you purchased. We don't offer support for customization, changes, or adding features. We also can't guarantee our products will work with other software or services.


You warrant that by using our services, you shall comply with all applicable laws, rules, and regulations, including, without limitation, applicable privacy and data protection laws, as well as applicable export or import controls, regulations, and sanctions.

Intellectual Property

Everything related to our website and services, including materials and intellectual property rights like text, graphics, logos, and source code, belongs to us or is licensed to us. These are protected by copyright, trademark, and other laws. You don't get permission to copy, sell, or distribute any part of our intellectual property through these Terms of Service.

Acceptable Use Policy

You are prohibited from renting, selling, reselling, sublicensing, or otherwise allowing any third party to use your account. This prohibition extends to the distribution, sale, or resale of your API keys or their transfer to another owner. API keys may only be employed on websites under your ownership or management.


We retain the unilateral discretion to terminate your access to the Services, without prior notice, for any reason or without reason, including but not limited to, the breach of the Terms of Service, infringement upon the rights of any individual, or violation of the law.

Changes to the Service

We retain the prerogative, which we may exercise at our sole discretion, to alter, suspend, restrict, or terminate parts or the entirety of our Services, as well as your access to them and your account, at any time and without liability or prior notice.


SKALE provides its services "as is." SKALE disclaims all warranties, whether express or implied, including but not limited to implied warranties of title, merchantability, fitness for a particular purpose, and non-infringement. SKALE does not warrant that its services will be error-free or that access to them will be continuous or uninterrupted. Your use of our services is at your own risk.

Limitation of Liability

SKALE, along with its suppliers, partners, or licensors, bears no responsibility for any direct or indirect, incidental, special, or consequential damages. This includes the cost of obtaining substitute products or services, interruption of use, data corruption, or loss, or any other harm arising from the use or inability to use our services. Our liability is confined to the fees you have paid to SKALE under the Terms of Service within the preceding twelve (12) month period before any damage arises.


You agree to protect and defend SKALE, as well as anyone acting on our behalf like owners, directors, employees, and partners, from any losses, liabilities, demands, damages, costs, claims, and expenses. This includes reasonable attorney fees, related to: (a) your use of our services, (b) your violation of these Terms of Service, (c) your breach of any agreement with third-party service providers used with our services, or (d) any content you submit on our website.

Amendments to These Terms

We can change the Terms of Service anytime without telling you beforehand. We'll let you know about the changes by updating the Terms of Service and showing the date we last changed them. If we think the changes are important, we might tell you through our services or other ways. The changes start working right away. It's your job to check the Terms of Service regularly. If you keep using our services and website after we change the terms, you're agreeing to the new rules.
